Terms of Use

1. About these terms

These Terms of Use ("Terms") govern your use of the Fortress VPN mobile application for iPhone ("App"), published on the App Store by AB PAINT SPRAYING LIMITED ("we", "us", "the Provider"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

The App is also subject to Apple's Licensed Application End User License Agreement, which applies in addition to these Terms.

2. What the App does

The App establishes an encrypted VPN connection between your device and a VPN server. While the connection is active, your internet traffic is routed through that server and your device's IP address is replaced by the server's IP address.

A VPN protects the connection itself. It does not make you anonymous to services you sign in to, does not remove content you publish, and is not antivirus software.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, sell, rent, sublicense, decompile, reverse engineer or modify the App, or remove any notices contained in it, except where such restriction is prohibited by law.

4. Eligibility

You must be able to enter into a binding contract in your country to use the App. If you are a minor, you may use the App only with the consent of a parent or legal guardian.

5. Acceptable use

You agree not to use the App to:

• break any law that applies to you, or help anyone else do so;
• send spam, malware, or otherwise attack, scan or disrupt any network or system;
• infringe intellectual property rights or distribute unlawful content;
• harass, threaten or impersonate others;
• circumvent limits, overload, or interfere with the operation of our servers or the App.

VPN use is restricted or regulated in some countries. You are responsible for checking and following the rules that apply where you are.

6. Subscriptions, billing and renewal

The App is free to download. Full functionality is offered as an auto-renewable VIP subscription with weekly, monthly and yearly options. Prices are shown in the App in your local currency before you confirm a purchase and may differ by country.

• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Renewal is charged within 24 hours before the current period ends, at the price of the plan you selected.
• You can manage or cancel your subscription in your Apple Account settings. Cancelling stops future renewals; the current paid period continues until it expires.
• Where a free trial is offered, any unused part of it is forfeited when you purchase a subscription.

All purchases are processed by Apple. We do not receive or store your payment details.

7. Refunds

Purchases made through the App Store are handled by Apple, and refunds are issued at Apple's discretion under its policies. Requests can be submitted at reportaproblem.apple.com. Statutory withdrawal or refund rights available to you under local consumer law are not affected. If you believe you were charged in error, write to support@fortress-vpn.co and we will help where we can.

8. Availability and changes

We work to keep the service available, but we do not guarantee uninterrupted or error-free operation. Servers, features and supported protocols may change, and maintenance may cause temporary interruptions. We may update the App, including changes needed for security or for compatibility with new versions of iOS.

9. Suspension and termination

We may suspend or end your access if you breach these Terms, or if we are required to do so by law. You may stop using the App at any time by cancelling your subscription and deleting the App from your device.

10. Disclaimer

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. No VPN can guarantee absolute security or protect you from every risk online.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profit or business, arising from your use of the App. Where liability cannot be excluded, it is limited to the amount you paid for the App in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

12. Apple

Apple is not a party to these Terms and is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to these Terms

We may update these Terms. The current version is always published on this page with the date it was last updated. Continuing to use the App after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales, without prejudice to the mandatory consumer protection rules of the country where you live.
